Why say they "don't exist"?  Why not use a more precise form of language by saying, "They
don't seem to exist in our observable universe"?

Yes, but your argument is equivalent to looking for your lost keys not where you may have
lost them, but where the light happens to be.  Consider the possibility that your
assumptions on what makes ET's detectable is flawed, and start looking elsewhere.  I wish
SETI all the best, but they are assuming that ET's are transmitting in the EM band, or that
they are sending omnidirectional signals in the first place.  It would be much more
efficient to send signals across interstellar distances in a tightly focused "laser" beam.
In that case, the chances of us detecting them through current SETI techniques are almost
nil.
